General Terms and Conditions (GTC)

1. Scope

 

These General Terms and Conditions (GTC) apply to all bookings of canyoning tours via the website, email, telephone, WhatsApp, or social networks (e.g., Instagram). The contractual partner is:

2. Conclusion of contract

 

A contract is concluded as soon as the customer submits a booking offer and this is confirmed by the provider in writing (e.g. by email, WhatsApp, SMS).

 

3. Services

 

The provider undertakes to carry out the canyoning tours agreed upon in the booking. The type, duration, and scope of the tour are determined by the respective service description on the website or by the individual agreement.

 

4. Prices and payment terms

 

All prices include all applicable charges.

Pursuant to Section6(1)(27) of the Austrian VAT Act (small business regulation), no value added tax (VAT) is charged.

Payment is made either in advance by bank transfer or directly on site in cash, unless otherwise agreed.

5. Cancellation conditions

 

Cancellations up to 7 days before the start of the tour are free of charge.

 

For cancellations within 7 days of the tour start, 50% of the price will be due.

 

In case of no-show without cancellation, the full price will be charged.

 

The provider reserves the right to cancel tours due to adverse weather conditions or safety concerns. In this case, an alternative date will be offered or the full price will be refunded.

 

6. Conditions of participation

 

Participants must be in good health and meet the requirements of the respective tour. The provider reserves the right to exclude participants in cases of obvious medical unfitness. In this case, no refund is possible.

 

7. Disclaimer

 

Participation in the canyoning tours is at your own risk. The operator is only liable for damages resulting from gross negligence or intent. No liability is assumed for personal belongings.

 

8. Insurance

 

The provider recommends taking out accident and rescue cost insurance for outdoor activities.

9. General provisions

 

The guest is participating in a guided tour offered by the tour operator. The guest acknowledges that the booked tour is an adventure activity that cannot offer the comfort and safety of a conventional leisure activity. During the tour, the guest will be exposed to natural influences that the guide cannot eliminate. There is a risk of extreme cold, precipitation, rockfall, water pressure, etc. These influences necessitate increased demands on fitness, health, and psychological well-being in order to participate in the tour. These requirements are set out in particular in the program description, the detailed description, and the introductory briefing. The guest is obligated to report any doubts about the fulfillment of these requirements, as well as any damage or injuries, immediately until the end of the tour.

10. Excluded persons

 

Persons who are impaired by drugs, medication, or alcohol, who do not meet the required requirements, who do not meet the requirements set out in point 9, or who violate the conditions of participation are excluded from participation. Exclusion may be declared at any time by the organizer or the guides after becoming aware of the reason for exclusion.

11. Security

 

Depending on the tour booked, guests will receive safety equipment. This equipment complies with the latest safety standards. Guests are required to treat rental equipment with care and familiarize themselves with its use and handling under the guidance of the guide. They are required to maintain and check the prescribed adjustments throughout the entire tour and to report any irregularities to the guide immediately. Our tours are led by professional, state-certified, and internationally certified canyoning guides. All tours are meticulously planned and prepared. Guests are required to follow the guide's instructions.

12. Liability and compensation

 

If a tour is interrupted, canceled, or changed for safety reasons or because another guest does not meet the requirements for participation, the guest is not entitled to any compensation whatsoever from the organizer. The guest is responsible for the proper return of rented equipment. Any rescue costs are to be borne by the rescued guest. Liability for damage to the guest's property due to slight negligence is excluded. Sensitive items (especially cell phones and cameras) are not permitted. Arrival and departure for the tours are by private vehicle. The organizer is not liable for any damage that occurs during this time.

13. Data protection

 

Personal data will be used exclusively to process bookings. Further information can be found in our .

 

 

14. Applicable law and place of jurisdiction

 

Austrian law applies. The place of jurisdiction for all disputes arising from this contract is the competent court at the company's registered office.
