General Terms and Conditions (GTC)

1. Scope

 

These General Terms and Conditions (GTC) apply to all bookings of canyoning tours via the website, email, telephone, WhatsApp, or social networks (e.g., Instagram). The contracting party is:

2. Conclusion of contract

 

A contract is concluded as soon as the customer submits a booking offer and this is confirmed by the provider in writing (e.g. by email, WhatsApp, SMS).

 

3. Services

 

The provider undertakes to carry out the canyoning tours agreed upon in the booking. The type, duration, and scope of the tour are determined by the respective service description on the website or by the individual agreement.

 

4. Prices and payment terms

 

All prices include all applicable charges.

Pursuant to Section6(1)(27) of the Austrian VAT Act (small business regulation), no value added tax (VAT) is charged.

Payment is made either in advance by bank transfer or directly on site in cash, unless otherwise agreed.

5. Cancellation policy

Cancellations up to 7 days before the start of the tour are free of charge.

For cancellations within 7 days of the tour start date, 50% of the price will be charged.

In case of no-show without cancellation, the full price will be charged.

The provider reserves the right to cancel tours, for example in case of bad weather or safety risks. In this case, an alternative date will be offered or the full price refunded.

6. Participation requirements

Participants must be in good health and meet the requirements of the respective tour. The organizer reserves the right to exclude participants who are clearly unfit for participation. In this case, there is no entitlement to a refund.

7. Disclaimer

Participation in the canyoning tours is at your own risk. The provider is only liable for damages resulting from gross negligence or intent. No liability is assumed for personal belongings.

8. Insurance

The provider recommends taking out accident and rescue cost insurance for outdoor activities.

9. General Provisions

The guest participates in a guided tour organized by the tour operator. The guest acknowledges that the booked tour is an adventure activity that cannot offer the comfort and safety of a typical leisure activity. During the tour, the guest will be exposed to natural elements that cannot be controlled by the guide. There is a risk of extreme cold, precipitation, rockfall, water pressure, etc. These elements necessitate a higher level of fitness, health, and mental preparedness to participate in the tour. These requirements are detailed in the program description, the detailed description, and the introductory briefing. The guest is obligated to report any doubts regarding their ability to meet these requirements, as well as any damage or injury, immediately until the end of the tour.

9. Excluded persons

Excluded from participation are persons who are impaired by drugs, medication, or alcohol, who do not possess the necessary qualifications, who do not meet the requirements outlined in point 6, or who violate the terms and conditions of participation. The organizer or guides may exclude a participant at any time after becoming aware of the grounds for exclusion.

10. Safety

Depending on the booked tour, guests receive safety equipment. This equipment meets the latest safety standards. Guests are obligated to treat rental equipment with care and to familiarize themselves with its use and handling under the guide's instruction. They must maintain the prescribed adjustments throughout the entire tour, check the equipment regularly, and immediately report any irregularities to the guide. Our tours are led by professional, state-certified, and internationally accredited canyoning guides. All tours are meticulously planned and prepared. Guests are obligated to follow the guide's instructions.

11. Liability and Compensation

In the event of a tour being cancelled, abandoned, or modified for safety reasons or due to another guest's lack of participation requirements, the guest is not entitled to any compensation from the organizer. The guest is liable for the proper return of the borrowed equipment. Any rescue costs must be borne by the guest being rescued. Liability for damage to the guest's property caused by slight negligence is excluded. Fragile items (especially cell phones and cameras) are not permitted. Travel to and from the tours is by private vehicle. The organizer is not liable for any damages that may occur during this time.

12. Data protection

Personal data is used exclusively for processing bookings. Further information can be found in our [privacy policy/terms of service].

13. Applicable Law and Jurisdiction

Austrian law applies. The place of jurisdiction for all disputes arising from this contract is the competent court at the company's registered office.

14. Note on natural variations in the tour route

The canyoning tours described in our information materials reflect the typical course and character of each tour. Due to natural factors such as water levels, weather, seasonal changes, or safety assessments by the guide, there may be variations in the details. In particular, the number, type, or height of jumps, slides, or rappels may vary or be omitted. The fundamental route and difficulty of the tour remain unaffected. These adjustments are made for safety and do not constitute a deficiency in the service.
